TB patient charged in Calif for not taking meds

SAN FRANCISCO (AP) ? Authorities in California took the unusual step of jailing and charging a tuberculosis patient who they say refused to take medication to keep his disease from becoming contagious.

Health officials said Armando Rodriguez, 34, of Stockton has active pulmonary tuberculosis, which can include coughing up blood or phlegm and can spread through the air.

Ramirez has been noncompliant with his treatment and could become contagious as a result, Ginger Wick, nursing director for San Joaquin County, said in a letter requesting a warrant for Rodriguez's arrest.

After failing one time to give himself the drugs, Ramirez told a nurse he had gone on an alcohol binge and taken methamphetamine and didn't want to hurt his liver, Wick said in her letter.

Rodriguez was arrested Tuesday and is expected to be arraigned Thursday on two misdemeanor counts of refusing to comply with a tuberculosis order to be at home at certain times and make appointments to take his medication.

He will likely be appointed a public defender.

Tuberculosis is a bacterial infection that usually attacks the lungs. Many people have a latent form, and the active form usually only affects adults whose immune systems are compromised, which can happen from drug use.

Public health experts are divided on the issue of mandatory treatment and criminal charges for patients who don't comply with treatment orders.

Many of those who do support criminal prosecution in the rarest of cases when public health is in jeopardy oppose the jailing of patients.

"I think it's an error to confine someone in the criminal justice system for a public health crime," said Lawrence Gostin, a Georgetown University public health law professor who drafted a model law adopted by several states struggling with the issue. "The whole intention is to protect the public's health. It's not to lay blame on someone."

Implementing mandatory treatment should be a last resort, and prosecuting someone for disobeying a public health order is unhelpful and sends the wrong message if protecting public health is the intent, Gostin said.

Instead, the afflicted should be given incentives such as transportation to and from treatments rather than punishment as an incentive to take their medicine, he said.

The Centers for Disease Control and Prevention said laws to control the spread of tuberculosis have been in use for more than a century, though regulations differ in each state.

As many as 12,000 new cases of tuberculosis are reported in the country each year, the CDC reported. California recorded 2,317 new cases in 2011, a low since records have been kept.

Nonetheless, officials throughout the nation continue to struggle to stop the spread of tuberculosis, with several drug-resistant strains emerging in recent years.

Federal and state officials don't keep records of the number of people prosecuted for refusing to take their medicines. But some say it's exceedingly rare to file criminal charges in such cases.

San Joaquin County has had more than 30 tuberculosis prosecutions since 1984, prosecutor Stephen Taylor said, noting the county is more aggressive than other jurisdictions in prosecuting patients to get them to take their medication.

"The criminal cases we're dealing with generally involve drug users who are harder to treat and manage because the TB medicines conflict with street drugs," he said. "We have to throw these people in jail and treat them as in-patients. They don't cooperate as out-patients."

Karen Furst, San Joaquin County public health officer, said the county arranges transportation and other services to help patients stick to their drug regimen and turns to the legal system only as a last resort.

"I have to make sure that if I'm aware that somebody is in a position that could possibly be spreading a disease to another person, that I take steps that are necessary to prevent that from happening," she said.

Rodriguez was discharged in March from San Joaquin General Hospital with four medications for active tuberculosis and agreed to take the drugs under observation by a county health official on weekdays and on his own on weekends, authorities said.

He allegedly refused to take the drugs on another day and then was not at home on three occasions and missed an appointment.

Each charge against Ramirez carries a maximum penalty of a year behind bars. In her letter, Wick said Rodriguez would need nine months of treatment.

Diggy Simmons Breaks Down Key Scenes In 'Two Up' Video

'I like how it came out overall for real. It's just a good feeling,' Diggy tells MTV News of his new video.

Diggy's "Two Up" party isn't over. On Friday, Young Mr. Simmons celebrated the premiere of his "Two Up" video with MTV's RapFix blog, and the teenage MC was so excited that he sat with MTV News and broke down each scene in the Clifton Bell-directed clip.

The vid begins with Diggy standing alone, playing air piano in time with the track's opening keys. The action may seem insignificant, but it's actually a key component to the song. "That was what really drew me to the track when I first heard the beat," he said. "It was just those piano keys that I love."

As the beat begins to take shape, so does the video, and a bouncer begins to let Diggy's specially invited guests into the party. Of course the crowd is compromised mostly of females. "There were so many girls at the shoot that we were like, 'We have to get some dudes in the mix,' " Diggy said, laughing at the non-dilemma.

"They were like New York, young kids, you know how they get," the MC said of the video's extras. "It was good energy and we didn't even have to tell them to get hyped at no point in the video. I was feeding off of their energy when I was in front of them during those shots. It was just easy."

It wasn't just the crowd that excited Diggy: The fashion-forward MC was also hyped at his on-camera wardrobe, though some of his favorite items didn't even make the cut. In one scene Simmons sports a turquoise jacket with two mini-Jesus pieces around his neck. On his feet he wears a special pair of black and gold Air Jordan #6s that were released back in 2006 and now go for as much as $850 online. "I'm kinda mad that you didn't get that in the shot," Diggy said of his coveted footwear.

Another key scene, in which a silhouetted Diggs dances across the screen, was actually inspired by another rap great. For the "Two Up" video, Simmons borrowed from Kanye West's 2007 clip for "Homecoming." "That whole silhouette idea is something that we drew inspiration from but made it a little different with the color, because that video is black and white," he explained. "I like how it came out overall for real. It's just a good feeling."

(AP) ? In the middle of the night, Tonya Thomas' neighbors awoke to the sound of a gunshot and moments later heard a knock on their door.

Three of Thomas' four children were outside, including one who appeared to have been shot. Before the neighbors could offer help, Thomas came out of her house and called the children back home.

They complied. The neighbors dialed 911 after hearing more gunshots.

Brevard County Sheriff's deputies found Thomas, 33, dead of an apparent self-inflicted wound and three of her children ? Jaxs Johnson, 15; Jazzlyn Johnson, 13; and Joel Johnson, 12 ? were fatally shot inside the house. A fourth child, Pebbles Johnson, 17, was found shot to death in the front yard of a neighbor's house.

Investigators said they didn't know a motive for the shooting and weren't sure why the children followed their mother's orders to return to the house.

"From what the neighbors said, she was very calm. She walked out and called them back. They turned around and walked back to the house," said sheriff's spokesman Lt. Tod Goodyear.

Another neighbor told deputies Thomas sent a text message in the middle of the night saying she wanted to be cremated with her children.

"He didn't see the text until he woke up this morning," Goodyear said.

The shooting happened in Port St. John, about 15 miles west of Cape Canaveral in an area known as the "Space Coast" because it is the home of NASA's Kennedy Space Center, the location of numerous shuttle launches.

Authorities went to Thomas' house on three successive days last month, according to dispatch records released Tuesday.

In the first visit, on Easter Sunday, Thomas reported that her son had thrown a bicycle through a window at the house. The next day, she called to report that her son had kicked and punched her when she tried to wake him up for school.

The following day, child welfare investigators visited the house to look into allegations of inadequate supervision of the children.

The Department of Children and Families was following up on a report on a Johnson child who had been released from a detention facility and hadn't been picked up by a caretaker, DCF spokeswoman Carrie Hoeppner said in an email.

Records showed Thomas was arrested in 2002 on a misdemeanor battery charge for striking Joe Johnson, the father of her children. The charge was later dropped. Two years earlier, she filed a domestic violence complaint against Joe Johnson, but that was dismissed after a hearing.

Jamie Hudson, whose mother lives two doors down from the family, said the boys in the family were known to shoot BBs at a home across the street and had threatened to set it on fire.

"It has been an ongoing problem on our street with them," Hudson said.

Goodyear said Jaxs Johnson had recently been arrested on a domestic violence charge. He said he didn't know if the boy had been accused of hitting his mother or causing damage at the house.

Austin Lewis, a 16-year-old classmate of Pebbles Johnson, said the family "had problems like everybody else but nothing that drastic."

He described Pebbles Johnson as "very loving and caring."

"Always with a smile," Lewis said. "Didn't let anything affect her. She was always in a good mood."

A pastor at the church the family attended described it as "normal stuff."

"I think he was punching some walls or something," said Jarvis Wash, pastor of the Real Church in Rockledge, Fla.

Wash said the family attended services last Sunday but had been absent for a few weeks before that.

"I don't know what could have happened in the past couple of days," Wash said. "It's a tragedy to the church and the community."

Facebook helped thousands of Israelis coordinate last summer?s socioeconomic protests, the biggest in Israel?s history. The site helped J Street turn from a fledgling, little-known upstart into a broad-based, left-wing alternative to the American Israel Public Affairs Committee.

Most Jewish community institutions, however, haven?t yet figured out how to maximize the potential of Facebook, according to Lisa Colton, president of Darim Online, a Virginia-based company that helps Jewish organizations adapt to the digital age.

Partly, Colton says, that?s because Facebook is inherently threatening to institutions.

?Facebook is about people more than it is about institutions. It supports individuals connecting with and learning from each other,? she said. ?It?s a wonderful way for individuals to circumvent institutions.?

Facebook enables Jews to construct communities organized around areas of interest rather than geography, religious denomination or institution.

When Hindy Poupko Galena and her husband, Seth, began using Facebook to update friends and family about their year-old daughter?s fight against a rare bone marrow disease, a community of sympathizers quickly emerged that included thousands of people who had never met the toddler, Ayelet.?

Strangers reached out to the Galenas -- members of the Modern Orthodox community on Manhattan?s Upper West Side -- not just with messages but with care packages.

?It allowed people to connect with what was going on on a very deep and real level,? Hindy said. ?So many people came out of the woodwork and emailed me and said, 'I had a sick kid and never told anyone about it, but I now feel that I can tell people about it.? ?

Even now, months after Ayelet?s death in January at age 2, the Facebook-based community, which they call Ayelet Nation, serves as a source of sympathy for the Galenas.

?For a girl who only lived two years, it?s very comforting to know that people know her name, and I think that was only possible because of Facebook,? Hindy said.

Whereas many Jewish institutions define their community by who?s inside and who?s out -- synagogues, JCCs and the Israeli Rabbinate, to name just a few -- Facebook offers an opportunity for Jewish community with no bounds.

?It can take Jewish leaders off their pedestals and get them to interact with real people and real life in a multidimensional way,? said William Daroff, the director of the Washington office of the Jewish Federations of North America who has more than 3,000 ?friends? on the social networking website. ?And it?s not just about the Jewish world, but a place for us to talk about our kids and our dogs and the games we like to play and who we really are.?

As Facebook evolves, the Jewish communities it enables will change, too.

?I think it really is analogous to having phone lines, which later enabled faxes and early Internet,? Colton said. ?With Facebook, it?s not about what we see and use today, it?s about what its foundations and widespread adoption make possible in the future.?
