SEC's Schapiro asks for tougher penalty powers (Reuters)

WASHINGTON (Reuters) ? U.S. Securities and Exchange Commission Chairman Mary Schapiro is asking Congress to expand its powers so it can impose tougher financial penalties against wrongdoers on Wall Street.

Schapiro's request, in a November 28 letter to two U.S. senators, comes as the agency is under fire for entering settlements that a federal judge criticized as too lenient.

On the same day that Schapiro spelled out her legislative wish-list to Congress, a federal judge in New York threw out the agency's proposed $285 million settlement with Citigroup Inc over the sale of toxic mortgage debt during the financial crisis.

U.S. District Judge Jed Rakoff called the monetary fine component of the settlement "pocket change" and said investors were being "short-changed."

The SEC had alleged investors lost $700 million from the bad bets, while Citigroup had planned to give up $160 million in ill-gotten profit.

In her letter to Senators Jack Reed and Mike Crapo, Schapiro expressed frustration the law limits the agency to calculating fines based on two methods.

The first method limits the SEC's financial penalty to an amount equal to the defendant's ill-gotten profits.

Schapiro requested two changes to that method. She said the SEC should have the ability to impose a penalty that is three times the amount of ill-gotten gains.

She also said the SEC should have the flexibility to base the fines on losses suffered by investors.

The second method under which the SEC is currently allowed to calculate fines says the agency can penalize individuals up to $150,000 per violation and up to $725,000 per entity. Under Schapiro's proposed changes, those numbers would go up to $1 million and $10 million, respectively.

"Together, these changes would provide the commission with greater flexibility with regard to monetary penalties in cases where the misconduct is very serious, repeated or involves substantial investor losses," she wrote.

The SEC has been on the defensive about the size and content of its settlements. In 2009, Rakoff also rejected a proposed settlement with Bank of America Corp until the two parties agreed to raise the figure.

Schapiro said in her letter she also wants the ability to enhance penalties for repeat offenders. She added that her staff will be preparing draft legislative language for lawmakers to consider.

American Airlines files for bankruptcy (Reuters)

(Reuters) ? American Airlines, the third-largest U.S. carrier, and its parent AMR Corp filed for bankruptcy protection on Tuesday to cut labor costs in the face of high fuel prices and dampened travel demand.

AMR, which replaced its chief executive in the move, had been mired for years in fruitless union negotiations, complaining all the while that it shoulders higher labor costs than rival domestic and foreign carriers that have already restructured in bankruptcy.

American Airlines, once the largest U.S. carrier, is now third behind United Continental Holdings Inc's United Airlines and Delta Air Lines Inc, both of which used Chapter 11 to cut costs and later found merger partners.

"The world changed around us," incoming Chief Executive Tom Horton told reporters on a conference call.

"It became increasingly clear that the cost gap between us and our competitors was untenable," he said.

AMR named Horton as chairman and chief executive, replacing Gerard Arpey, who retired.

The airline said it and its regional affiliate American Eagle would continue to operate as usual, fly their normal schedules, honor reservations and make exchanges and refunds.

American Airlines hopes bankruptcy will cut labor costs, but analysts question whether restructuring under Chapter 11 of U.S. Bankruptcy Code will address operational shortcomings and bolster revenue.

"Bankruptcy is not necessarily the be-all, end-all," said Helane Becker, an analyst with Dahlman Rose & Co. "They've got more problems to address in addition to the cost problem."

She said the airline industry has been hit by high fuel and labor costs, but filing for bankruptcy would not solve AMR's problems, and the airline needed to rework its operations and boost revenue.

Shares of AMR, whose passenger planes average 3,000 daily U.S. departures, had slid 45 percent from the end of September through Monday. On Tuesday the shares tumbled 79 percent to 34 cents on the New York Stock Exchange. Stock in bankrupt companies typically is wiped out when a company exits Chapter 11 and new shares are issued, making the old shares worthless.

Shares of rival airlines rallied on expectations that fares could rise, as AMR kept a lid on industrywide fares in its effort to keep its airplanes full.

United Continental shares jumped 6.2 percent to $17.60, while US Airways Group Inc climbed 4.7 percent to $4.47 and Delta Air Lines rose 4.2 percent to $7.74.

SLIMMED-DOWN AMR

Under its Chapter 11 bankruptcy filing in a New York court, the company listed assets of $24.72 billion and liabilities of $29.55 billion. The company has $4.1 billion in cash.

AMR's top rivals, UAL and Delta, used bankruptcy protection to slash costs and have since bought out other airlines: Delta bought Northwest Airlines, and UAL bought Continental Airlines to form United Continental Holdings.

US Airways and United Airlines sought relief under Chapter 11 bankruptcy in 2002. Delta and Northwest filed in September 2005. Japan Airlines Co Ltd, one of American Airlines' alliance partners, filed for bankruptcy last year.

Wi-Fi-Connected Laptop Hurts Sperm, Study Suggests (LiveScience.com)

A computer with a wireless Internet connection hurts sperm, but not because the machine can heat up your lap, a new study suggests.

The findings showed that sperm cells collected in lab dishes and placed beneath a laptop with a wireless Internet connection for four hours had less motility and more DNA damage than sperm placed in another room, away from electronic devices but kept at the same temperature.

"It is well-known that increased temperature may decrease sperm quality, and the use of portable computers on the lap increases scrotal temperature," the researchers wrote in their study.

But the findings suggested it wasn't the temperature beneath the laptop that was affecting sperm; instead, the radiation from the laptop was slowing the swimmers, according to the study. ?

Laptops emit radiation

The researchers in Argentina and Virginia used semen samples from 29 healthy men, whose average age was 34. The laptop was set to download and upload information over the course of the experiment, so the wireless connection was actively being used. The temperature under the laptop was held constant at 77 degrees Fahrenheit by an air-conditioning system. ?

Wireless Internet connections use radio-frequency electromagnetic waves. When the researchers measured the radiation coming from a laptop wirelessly connected to the Internet, they found it was at least three times higher than an unconnected laptop, and seven to 15 times higher than radiation in a general setting, according to the study, though the levels varied over the course of the experiment, depending on the flow of information coming to or from the computer.

There was no difference between the sperm samples held under the laptop and those kept away from it in terms of the percentage of sperm that were dead at the end of the experiment, according to the study.

Still, sperm motility and having undamaged DNA are important for fertilizing an egg.

"We speculate that keeping a laptop connected wirelessly to the Internet on the lap near the testes may result in decreased male fertility," the researchers wrote in their conclusion.

Why sperm cells are vulnerable

Sperm cells are different from other cells in the body ? their DNA is highly condensed into a small area, the researchers noted. This could make them more vulnerable to the effects of such radiation.

It's plausible that the magnetic and electromagnetic fields produced by the radio waves damage molecules in sperm called phospholipids, which are a needed to keep membranes within a sperm cell intact, the study researchers wrote.

It is not known whether all laptop computers might have the same effects as those seen in this study, nor is it known what other factors might heighten or lessen the damage, the researchers wrote in their conclusion.

"However, we cannot discard the possibility that damage to sperm is caused by the low radiation produced by the computer without Internet connection," they wrote, and this possibility should be studied further.

The study was published online Nov. 23 in the journal Fertility and Sterility.

New Mass translation launches in American parishes (AP)

CLAYTON, N.C. ? English-speaking Roman Catholics who have regularly attended Mass for years found themselves in an unfamiliar position Sunday, needing printed cards or sheets of paper to follow along with a ritual many have known since childhood.

"I don't think I said it the right way once," said Matthew Hoover, who attends St. Ann Catholic Church in Clayton, a growing town on the edge of the Raleigh suburbs. "I kept forgetting, and saying the old words."

The Mass itself ? the central ritual of the Catholic faith ? hasn't changed, but the English translation has, in the largest shakeup to the everyday faith of believers since the upheavals that followed the Second Vatican Council in the 1960s. A years-long process of revision and negotiation led to an updated version of the Roman Missal, the text of prayers and instructions for celebrating Mass, which originally was written in Latin. The new translation was rolled out across the English-speaking Catholic world on Sunday after months of preparation.

Mickey Mattox, a professor at Milwaukee's Marquette University, said he was happy with the idea that the bishops wanted the translations as accurate as possible.

Adapting to the changes "was a lot less difficult than I thought it might be," said Mattox, 55, adding, "even though probably all of us are going to end up holding our worship folders for a few weeks until we memorize all the new language."

The Rev. George Witt, pastor of the Church of St. Ignatius Loyola on New York's Park Avenue, started the 11 a.m. Mass by noting Sunday was not only the first day of Advent, but also the first day to use the new Missal. He directed parishioners to a pamphlet inserted into the back of the now-outdated hymnal that spelled out the new wording. A notable number of worshippers stumbled after the priest said, "Peace be with you." The new response is "And with your spirit" instead of "And also with you." But many others confidently gave the right response.

Kathleen McCormack, a church volunteer and former school teacher, said she didn't like the new translation and didn't understand why the church needed a translation closer to Latin.

"Consubstantial? What is that word?" McCormack said, referring to a term in the retranslated Nicene Creed that replaces language calling Jesus "one in being with the Father."

But she saw a cautionary tale in the many Catholics she saw distance themselves from the church over changes made after the modernizing reforms of the Second Vatican Council.

"It's not shaking my church experience," said McCormack, as she handed out church bulletins. "You have the spirit between you and God and the words are insignificant."

Most of the changes are actually to prayers recited by the priest, but some of the changes for prayers spoken or sung by the congregation revise familiar words that for some people are spoken almost automatically after years of churchgoing.

Along with the new response and unfamiliar words, the affirmation "We believe" has been replaced with "I believe" in the Nicene Creed. Some of the language seems more formal or poetic: the word "cup" has become "chalice."

"It's more British in some ways," said Monsignor Michael Clay, pastor of St. Ann. "But this is the first time that every English-speaking country in the world will be using the same translation of the Mass."

Clay likes the new translation, finding it closer to the Latin text that is still the church's official language. But some priests and parishioners have been less enthusiastic, criticizing the new version as too ponderous or distant, and in some cases circulating petitions asking for a delay in introducing the new missal.

Maribeth Lynch, 51, a publisher from the Milwaukee suburb of Elm Grove, said she was "distraught" over the changes and would refuse to "learn the damn prayers."

"It's ridiculous. I've been a Catholic for 50 years, and why would they make such stupid changes? They're word changes. They're semantics," she said.

"It's confusion. All it's doing is causing confusion," she said. "You want to go to church and be confused?"

The roots of the new translation go back to that epochal council held at the Vatican in the 1960s, which allowed Mass in languages other than Latin. An English-language missal was produced by 1973, but that was intended to be temporary while improvements were made.

In 2001, the Vatican office that oversees worship issued a directive requiring translation of the English missal that would be closer to the Latin rather than to more familiar vernacular speech. Numerous revisions and bishops' meetings eventually produced agreement on the translation being used Sunday.

Parishes and dioceses around the country have spent months trying to prepare Catholics for the change. Descriptions of the new translation have been printed in weekly bulletins, seminars have been held and, since Labor Day, many parishes have been gradually introducing the new translation piece by piece, starting with the parts of the liturgy that are sung.

Most of those activities are for the benefit of the average Catholic, but it's priests who have more new material to master.

"I've had a new missal in my hands for about three weeks now, and I've been literally practicing the prayers," Clay said. "I've been doing this now for 31 years, and a lot of these prayers I actually know by memory. I have to make sure my brain isn't getting ahead of my mouth."

Violence mars Black Friday shopping (AP)

SAN LEANDRO, Calif. ? Black Friday's typical jostling and jockeying took a more ominous turn during this year's bargain-hunting ritual with a shooting, a pepper spraying and other episodes of violence that left several people injured.

In the most serious case, a robber shot a shopper who refused to give up his purchases outside a San Leandro, Calif., Walmart store, leaving the victim hospitalized in critical but stable condition.

Police in San Leandro, about 15 miles east of San Francisco, said the victim and his family were walking to their car around 1:45 a.m. Friday when they were confronted by a group of men who demanded their shopping items. When the family refused, a fight broke out, and one of the robbers pulled a gun and shot the man, said Sgt. Mike Sobek.

"The suspects saw these guys, got out of their car and tried to rob them but were unsuccessful," Sobek said.

At another Walmart in a wealthy suburb of Los Angeles, a woman trying to get the upper hand to buy cheap electronics unleashed pepper spray on a crowd of shoppers, causing minor injuries to 20 people, police said.

The attack took place about 10:20 p.m. Thursday shortly after doors opened for the sale at the Walmart in Porter Ranch in the San Fernando Valley.

The store had brought out a crate of discounted Xbox video game players, and a crowd had formed to wait for the unwrapping, when the woman began spraying people "in order to get an advantage," police Sgt. Jose Valle said.

Ten people were slightly injured by the pepper spray and 10 others suffered minor bumps and bruises in the chaos, Valle said. They were treated at the scene.

The woman got away in the confusion, but could face felony battery charges if found, Valle said.

Meanwhile, police in suburban Phoenix came under fire when a video was posted online showing a 54-year-old grandfather on the floor of a Walmart store with a bloody face, after police said he was subdued Thursday night trying to shoplift during a chaotic rush for discounted video games.

The video, posted on YouTube, shows Jerald Allen Newman unconscious and bloodied as outraged customers yell expletives and say "that's police brutality" and "he wasn't doing anything."

In a police report that redacted the names of officers and witnesses, Newman's wife and other witnesses said he was just trying to help his grandson after the boy was trampled by shoppers, and only put a video game in his waistband to free his hands to help the boy.

Larry Hall, assistant chief of Buckeye police, said Newman was resisting arrest and it appeared the officer acted within reason.

Hall said the officer decided to do a leg sweep and take him to the ground but the man unfortunately hit his head.

"The store was incredibly crowded, and I was concerned about other customers' safety," the officer wrote in his police report.

Hall said Newman, who had a bloody nose and received four stitches on his forehead, was booked on suspicion of shoplifting and resisting arrest.

In Sacramento, Calif., a man was stabbed outside a mall Friday in an apparent gang-related incident as shoppers were hitting the stores.

The victim was taken to a hospital with non-life-threatening injuries, police said.

The stabbing stemmed from a fight between two groups around 3 a.m. in front of a Macy's department store at the Arden Fair Mall.

No arrests have been made. Police were hoping surveillance video will help identify the suspects.

US ranchers: We live in fear along Mexican border

While walking along a dirt road bordering his property, a South Texas farmer complained about living in fear of Mexican traffickers smuggling drugs and illegal immigrants across his land. He would later ask his visitor not to reveal his identity, for his safety and that of his family.

"I'm a citizen of the United States. This is supposedly sovereign soil, but right now it's anybody's who happens to be crossing here," he said. "I'm a little nervous being here right now. Definitely don?t come down here after dark."

The farmer said a federal law enforcement agent told him to buy a bulletproof vest to use while working in his fields. Whenever he goes out to survey his agricultural operations, he always tells his office where he is headed, and he has purchased a high-powered rifle.

"One of the basic points of the federal government is to protect the people of this nation to secure the border, and they're not doing that," he complained.

The Obama administration and many local officials have said the U.S.-Mexican border is safer than ever and that reports of violence on the American side are wildly exaggerated. But the farmer scoffed at that argument. "I walk this soil every day and have since I was old enough to come out on my own," he said. "In this part of Texas, it is worse than it's ever been."

Moving families to safer ground
A report recently released by the Texas commissioner of agriculture said cross-border violence was escalating. "Fear and anxiety levels among Texas farmers and ranchers have grown enormously during the past two years," the report said, adding that some ?have even abandoned their livelihoods to move their families to safer ground."

Retired U.S. Army Gen. Barry McCaffrey, who served as the U.S. drug czar during the Clinton administration and as an NBC News military analyst, is a co-author of the report. During a recent interview, McCaffrey said that while major cities along the Texas border are "pretty safe," the rural areas between towns are "largely unprotected, and across those areas the (Mexican) cartels are conducting massive movements of illegal drugs and other criminal activity."

Law enforcement agents say they are seeing more aggressive efforts by Mexican traffickers operating in the Rio Grande Valley. In South Texas alone, the traffickers smuggle hundreds of tons of drugs a year into the United States by floating them on rafts across the Rio Grande, then transporting them by car, truck or on foot ? often across private land ? into the United States.

The smuggling ?clearly has intimidated U.S. citizen who don't believe they're safe on their own land in their own country," McCaffrey said.

Several Texas congressmen and sheriffs have condemned the report, saying its conclusions are overstated and politically driven. But McCaffrey claims the officials not facing facts.

"I think there is an element of denial," McCaffrey said. "Inside the beltway the senior law enforcement, I think, have fallen in line and said, no, that's right, the U.S. border is the safest place in America, which is errant nonsense."

Ranchers protecting themselves
Veterinarian and rancher Mike Vickers heads the Texas Border Volunteers, a group of about 300 landowners and supporters who work closely with law enforcement officials to track drug and immigrant smugglers entering the U.S. from Mexico and crossing private land. His primary concern, he said, is the safety of farmers and ranchers who have been confronted by armed traffickers.

"A lot of them have been threatened not to call the Border Patrol or law enforcement if they see smuggling going on their property, otherwise they'll be killed or their family members may be killed," he said.

During a tour of his land and that of a neighbor, Vickers pointed out numerous hiking trails worn by smugglers and illegal immigrants from around the world. He also showed where many parts of the wire fence had been cut and pulled back. "This is not done by wildlife," he said. "This is done by smugglers and more than likely drug smugglers that have heavy backpacks full of drugs so they can drag the backpack underneath and not have to throw it over the fence."

In order to prove their claims that thousands of smugglers and illegal immigrants are crossing private American land, the Texas Border Volunteers have erected hidden cameras and share the images with state and federal agents. Describing one of the pictures, Vickers said, "This individual's got at least 80, maybe 100 pounds on his back. This is probably marijuana with a canvas covering." Another black and white photograph showed a man hoisting a smaller load. "You know he's carrying at least 40 pounds of drugs in that backpack. We suspect cocaine."

Vickers said that since 2004, about 500 people, mostly illegal immigrants, have perished while on smuggling trips through private property in Brooks County, Texas, alone, where his ranch is located.

A war zone?
Todd Staples, the Texas agriculture commissioner and a candidate for lieutenant governor, argued that many leaders in Washington, D.C., continue to ignore the violence along the border. In a recent article he wrote, "A Webb County rancher checking his cattle is shot at and barely escapes with his life; the suspects are linked to drug cartels. Workers in a Hidalgo County sugarcane field are told by cartel members to stop harvesting the crop 'or else," because the sugarcane provides coverage for cartel coyotes smuggling drugs."

Vickers said he knows ranchers who have moved their families into nearby cities for their protection and have taken other safety measures. "Everyone is packing a weapon and carrying a cell phone with them. and they're crazy if they don't," he said. "This is happening on American soil; this is a war zone here, there's no question about it."

The use of the phrase "war zone" to describe the U.S. side of the border is controversial. The report to the agriculture commissioner states, "Living and conducting business in a Texas border county is tantamount to living in a war zone in which civil authorities, law enforcement agencies as well as citizens are under attack around the clock."

Democratic congressmen and some local officials say that conclusion is unfair. Hidalgo County Sheriff Lupe Trevino was recently quoted by the Houston Chronicle as saying, "The border is not in chaos.? And the newspaper quoted Rep. Silvestre Reyes, a Democrat representing El Paso, as calling the claims "political rhetoric" meant to embarrass the Obama administration.

Among ranchers, farmers and law enforcement agents working at the ground level, however, there is considerable agreement that large-scale drug smuggling from Mexico into the United States has been increasing in recent years and that the traffickers are becoming more aggressive. For the farmer too afraid to be identified publicly, it creates a painful dilemma.

"I can't pick up and move this farm; we're tied to the land," he said. "This is the front door to our country. Help us stop it here."

CAIRO (AP) ? Two of three American students arrested during a protest in Cairo caught flights out of Egypt early Saturday, and the third was scheduled to leave later in the morning, according to an airport official and an attorney for one of the trio.

The three Americans were arrested on the roof of a university building near Cairo's iconic Tahrir Square last Sunday. Officials accused them of throwing firebombs at security forces fighting with protesters.

Luke Gates, 21, left Cairo early Saturday morning on a flight to Frankfurt, Germany, an airport official said in Cairo. Gregory Porter, 19, also left the country, his attorney said.

All three were expected to have departed on separate flights by later Saturday morning, the airport official said. He spoke on condition of anonymity because he was not authorized to brief reporters.

An Egyptian court ordered the release of Gates, Porter and 19-year-old Derrik Sweeney on Thursday. All were studying at the American University in Cairo.

Attorney Theodore Simon, who represents Porter, a student at Drexel University in Philadelphia, said police escorted the three students to the Cairo airport Friday. Simon later said his client was on a flight.

"I am pleased and thankful to report that Gregory Porter is in the air. He has departed Egyptian airspace and is on his way home," Simon said, though he declined to say when Porter was expected back in the U.S.

Simon said he and Porter's mother both spoke by phone with the student, who is from the Philadelphia suburb of Glenside.

"He clearly conveyed to me ... that he was OK," Simon told the AP.

Gates is a student at Indiana University. It wasn't clear when he was expected back in the U.S.

Joy Sweeney told the AP her son, a 19-year-old Georgetown University student from Jefferson City, Missouri, would fly from Frankfurt to Washington, then on to St. Louis. She said family will meet him when he arrives late Saturday.

"I am ecstatic," Sweeney said Friday. "I can't wait for him to get home tomorrow night. I can't believe he's actually going to get on a plane. It is so wonderful."

Sweeney said she had talked with her son Friday afternoon and "he seemed jubilant."

"He thought he was going to be able to go back to his dorm room and get his stuff," she said. "We said, 'No, no, don't get your stuff, we just want you here.'"

She said American University will ship his belongings home.

Sweeney had earlier said she did not prepare a Thanksgiving celebration this week because the idea seemed "absolutely irrelevant" while her son still was being held.

"I'm getting ready to head out and buy turkey and stuffing and all the good fixings so that we can make a good Thanksgiving dinner," she said Friday.
